Rental Terms &
Conditions

Please read these terms carefully before renting a vehicle with StatusFlamingo.

STATUSFLAMINGO CORP, specialized in vehicle rentals, presents its services under the following terms and conditions, which govern the contractual relationship upon completion of the reservation and the execution of the contract signed by the client, who, by signing this instrument, declares full awareness, understanding, and agreement with all clauses herein.

1

Liability Insurance

A valid and enforceable liability insurance policy and personal injury protection insurance of any authorized rental driver shall be considered primary with respect to the liability limits required under §§ 324.021(7) and 627.736 of the Florida Statutes.

All prices displayed on this website include the Collision Damage Waiver (CDW). Your responsibility for collision damage to the vehicle shall be limited to $0.

2

Prohibited Uses

Certain uses of the vehicle are considered Prohibited Uses. The following are prohibited:

  • By anyone without a valid license, under the influence of substances, or without experience in manual transmission
  • For any illegal purpose or circumstances constituting a felony
  • To transport persons or goods for hire or compensation (Uber, Lyft or similar)
  • To push or tow objects, teach someone to drive, or carry objects on the roof
  • In races, speed tests, or contests
  • To transport hazardous, dangerous, or illegal materials
  • Outside the United States, Canada, or the geographic area described in this agreement
  • When loaded beyond the manufacturer's specified capacity or on unpaved surfaces
  • Transporting more persons than available seat belts, or children without approved safety seats
  • When the odometer has been tampered with or fluid levels are low
  • After an accident without contacting police
  • To transport animals (except service animals)
  • While using a handheld communication device without hands-free mode

Also prohibited: failing to report accidents, providing false information, and smoking or vaping inside the vehicle.

PROHIBITED USE OF THE VEHICLE VIOLATES THIS AGREEMENT, AUTOMATICALLY TERMINATES THE RENTAL, AND VOIDS ALL LIABILITY AND INSURANCE COVERAGE (TO THE EXTENT PERMITTED BY LAW).
3

Age & License Requirements

The minimum driver age is 23 years and the maximum is 65 years, with at least three years of driving experience. A valid U.S. driver's license is required. Learner's permits are not accepted.

4

Vehicle Return

The client agrees to return the vehicle in the same condition received. Failure to comply will result in the following penalties:

  • Lost documentation — indemnification of €30 for administrative costs
  • Fuel below original level — client pays for the missing fuel
  • Cleaning — fee of up to €60 if returned excessively dirty
  • Damage — full liability per clause 3 if not covered by insurance

Failure to return the vehicle constitutes evidence of abandonment, subject to penalties under § 812.155 of the Florida Statutes.

5

Vehicle Equipment

The vehicle is delivered with: warning triangle, standard tools, spare wheel, five marked tires, registration booklet and title, green insurance card, a copy of the signed rental agreement, and, if applicable, an inspection sheet.

6

Fines & Penalties

The client is responsible for all fines or penalties. An administrative fee of up to $40 USD will be applied for managing these processes, in addition to the fines themselves.

7

Breakdown & Assistance

In case of breakdown, the client must immediately contact the company:

STATUSFLAMINGO Assistance: +1 786-352-3797 or +1 786-374-9971 — available 24 hours.

If improper fuel is introduced, the client is responsible for all related expenses including fuel replacement, tank cleaning, engine tuning, and towing.

8

Maintenance & Replacement Vehicle

Routine mechanical maintenance due to normal use is the company's responsibility. If the vehicle becomes immobilized for mechanical reasons not due to misuse, a vehicle of the same or higher class will be provided at no additional cost.

No replacement vehicle will be provided in case of accidents caused by the renter or mechanical failure due to negligence, and no rental refund is due.

9

Extension & Return

The rental ends on the date specified by the client. To extend, the client must visit the nearest station 24 hours before the end of the rental period. Failure to obtain consent will be considered unauthorized use subject to legal consequences.

The rental cost and any additional services must be paid at the start of the rental based on the current price list.

10

In Case of Accident

The client agrees to protect the interests of STATUSFLAMINGO in case of accident during the rental period by:

  • Immediately notifying the police at 911
  • Obtaining names, contacts, and addresses of involved parties and witnesses
  • Not admitting responsibility or fault
  • Not abandoning the vehicle without taking proper measures to protect it
  • Not moving the vehicle until properly documented photographically

The accident must be reported to STATUSFLAMINGO within 2 hours. Failure to do so may void insurance options.

11

General Provisions

Any modifications to the terms and conditions of this document are null unless agreed upon in writing.

The client releases STATUSFLAMINGO from any liability for loss or damage to property left or transported in the vehicle.

STATUSFLAMINGO assumes no responsibility for delays or losses, including missed flights, caused by vehicle breakdowns or accidents.

It is expressly prohibited to use the vehicle for Uber, Lyft, or similar ride-sharing services. Violation constitutes a Prohibited Use of the Vehicle and may result in immediate termination of the rental agreement and full client liability.
